1. Who we are

Webshed is the trading name of Oleksandr Kolchyk, a self-employed sole trader based in Ireland at Enniscorthy, Co. Wexford, Ireland. As a sole trader, I am personally the data controller responsible for your personal data collected through this website (brainysolutions.net).

This policy covers only data collected through this website. If we build a website for you, you are the data controller for your own site's visitors and customers — see Section 10 of our Terms of Service.

2. What personal data we collect

Data you give us directly, when you submit our contact form:

  • Name
  • Email address
  • Phone number (optional)
  • Project type and estimated budget you select
  • Any message or project details you write

Data collected automatically: this website does not currently use any analytics or tracking tool, so no automatic usage data is collected at this time. We plan to add Google Analytics soon — see Section 4 for what that will involve once it's switched on.

Live chat (if you use it): your messages, a visitor ID (a random code stored in your browser so we can recognise you if you come back), your IP address and the approximate region derived from it, and the page you were on when you started chatting. If you tell us your name, email, or phone number in the chat, we store that too. Live chat is switched on by default — see Section 4 for how it works and how to turn it off.

We do not collect payment card details on this website. We only collect the data described above — we don't ask for more than we need to respond to your enquiry, understand site usage, or run the live chat.

We do not use your data for any automated decision-making or profiling that produces legal or similarly significant effects on you.

4. Cookies, local storage, and live chat

This website does not currently use Google Analytics, or any other analytics or tracking tool. We plan to add Google Analytics (provided by Google Ireland Limited) soon to understand how visitors use the site. Before we switch it on, we will update this section — and Section 5 (retention) and Section 6 (who we share data with) — with the full details, and it will only ever run after you actively consent via the cookie banner, never automatically.

Once active, Google Analytics will use cookies — small text files stored on your device — to collect anonymised/pseudonymised usage statistics. You will be able to opt out at any time by installing the Google Analytics Opt-out Browser Add-on, or by adjusting your cookie preferences via the "Cookie Settings" link in the website footer. Google's own privacy practices are described in the Google Privacy Policy.

Live chat. Our live chat widget runs on our own server, not a third-party chat provider. It's switched on by default so it's available as soon as you land on the site, and it uses your browser's local storage (not a cookie, but used for the same purpose) to remember a visitor ID across visits and keep your conversation history. When you start a chat, we also look up the approximate region your IP address belongs to, using a third-party IP-lookup service, and we keep that IP address so we can block abusive use of the chat if it's ever needed. We tell you all of this upfront, in the cookie banner, before the chat is used — you don't need to do anything for it to work, but you can turn it off at any time via the "Chat" toggle in Cookie Settings (see the website footer). Turning it off hides the widget and stops any further data being collected through it.

Our cookie banner also includes a "Marketing" category (for tools such as Meta Pixel). This category is not currently in use — no marketing or advertising cookies are active on this website at this time, even though the option is shown. If we activate marketing cookies in future, we will update this policy — including the "Who we share your data with" section below and the relevant legal basis — before doing so.

5. How long we keep your data

  • Contact form enquiries: kept for 24 months from your last contact with us, after which they are deleted unless you become a client (in which case the record-keeping period below applies).
  • Client project and contract records (quotes, invoices, correspondence relating to a paid engagement): kept for at least 6 years after the engagement ends, in line with Irish Revenue's statutory record-keeping requirements for tax and accounting purposes.
  • Live chat conversations: kept for 24 months from your last message in the chat, after which they are deleted, unless you become a client (in which case the record-keeping period above applies). IP addresses we've had to block are kept to prevent repeated abuse of the chat.
  • Google Analytics data: not applicable yet, as Google Analytics is not currently active on this website (see Section 4). Once we switch it on, we will state the retention period here before it goes live.

We may keep data for longer than the periods above where necessary to establish, exercise, or defend a legal claim.

6. Who we share your data with, and international transfers

We do not sell your personal data. We share it only with service providers who help us run this website and our business, under data processing agreements:

  • Google Ireland Limited (Google Analytics) — website analytics. Not active yet — see Section 4; this recipient applies once we switch Google Analytics on.
  • Our IP-lookup provider — used only to show us the approximate region of a new live chat visitor.
  • Our hosting provider — a private virtual server used to run this website.
  • Our own email server (SMTP) — not a third-party email marketing service — used solely to deliver contact-form notifications.

Some of these providers may process data outside the European Economic Area (EEA) — for example, Google may transfer data to the United States. Where this happens, it's covered by appropriate safeguards, such as the EU-US Data Privacy Framework (where the recipient is certified under it) or Standard Contractual Clauses.

7. How we protect your data

We take reasonable technical and organisational measures to protect the personal data we hold, including encrypted (HTTPS) connections to this website, restricted access to our hosting and email accounts, and keeping software up to date. No method of transmission or storage is completely secure, but we work to protect your data against unauthorised access, loss, or misuse.

8. Children's privacy

This website and our contact form are not directed at, or intended for use by, children, and we do not knowingly collect personal data from anyone under 16. If you believe a child has provided us with personal data, please contact us and we will delete it.

9. Links to other websites

Our website may contain links to third-party websites (for example, our portfolio, social media, or partners). We aren't responsible for the privacy practices of those sites — please check their own privacy policies before providing any personal data to them.

10. Your rights

Under the GDPR, you have the right to:

  • Access the personal data we hold about you
  • Correct inaccurate data
  • Delete your data ("right to be forgotten")
  • Restrict or object to certain processing
  • Data portability — receive your data in a structured, machine-readable format
  • Withdraw consent at any time (e.g. for Google Analytics or live chat), without affecting the lawfulness of processing before withdrawal

11. Complaints

If you believe we have not handled your personal data properly, you have the right to lodge a complaint with the Irish supervisory authority:
